E-Gov Privacy Provisions Memo

SUBJECT: Implementation of the E-Gov Act Web Privacy Provisions

As you are aware, OMB has issued new guidance for implementing the privacy provisions of the E-Government Act of 2002. Part III of the OMB guidance, "Privacy Policies on Agency Web Sites," requires that Federal agencies modify their Web privacy policies and their Web sites by December 15, 2003, to incorporate the OMB Web privacy guidance. The changes do not apply to agency intranet sites that are accessible only to authorized government users (employees, contractors, consultants, fellows, or grantees).

The changes required by Part III fall into two groups:

  • changes applicable to all agency Web sites accessible to the public. Guidance for these is provided in Attachment A.
  • changes applicable only to agency Web sites associated with a Privacy Act System of Records (a records system containing personally-identifiable information). Guidance for these Web sites is provided in Attachment B and includes the Attachment A information.

The revisions necessitated by the E-Gov Act do not fundamentally change the existing Commerce Web policy, which can be found at http://www.osec.doc.gov/webresources/, along with guidance on how to implement the changes.
